خشونت كلامي خانگي عليه زنان و راهكارهاي قانوني برخورد با آن

Verbal Violence against Women and Legal Approaches to Deal with it

يكي از اقسام خشونت كه نيازمند توجه بيشتر و همه جانبه در جامعه كنوني است، خشونت جنسي كلامي است؛ بخصوص كه امروزه با رشد روزافزون ميزان طلاق، شاهد افزايش اين نوع خشونت عليه زنان هستيم. بر اين اساس، شناخت قلمرو آن در متون فقهي-حقوقي و ارائه آگاهي هاي حقوقي پيشگيرانه و حمايت قانوني از زنان در معرض خشونت كلامي خانوادگي، ضروري است. بررسي اين موضوع، مستلزم پرداختن به آراء فقها و حقوقدانان، كاوش در مواد قانوني كشور ايران اسلامي و مد نظر قراردادن حكم عقل، بناي عقلاء و آيات و رواياتي است كه به مناسبت هاي مختلف، به دفاع از حقوق زوجه در قبال تجاوزات زوج در عرصه كلام برخاسته اند. بررسي موضوع نشان مي دهد، اگرچه در روابط زوجين رياست خانواده از خصايص شوهر است ولي اين امر اطلاق ندارد و زوج ملزم به حسن معاشرت و معاضدت در زندگي مشترك است و قانون گذار با تحديد ميزان اختيارات رياستي شوهر، اهتمام ويژه بر حفظ حقوق زوجه دارد.

One of the forms of violence that needs more attention in our society is verbal sexual violence; with the increasing growth of divorce rate we see an increase in this kind of violence against women. Accordingly, it is necessary to recognize its territory in legal texts and provide legal awareness and legal protection of women exposed to family verbal violence. Examining this issue involves addressing the opinions of jurists and lawyers, exploring the legal materials of the Islamic Republic of Iran, and considering the judgment of reason, rationales, verses, and narrations that, on various occasions, protect the rights of the wife against verbal aggression. Though husband is the head of family in the family relations but his presidency is not categorical. Husband is obliged to have good communication with his wife and to be a good assistant and supporter for her in their common life. Limiting the powers of the husband's presidency, legislator should effort to preserve the rights of wife.
