Assignment of Arbitration Agreement

يكي از مسائل حل نشده در حوزه حقوق داوري آن است كه با انتقال عقد اصلي، شرط داوري ضمن آن يا قرارداد داوري مرتبط با آن نيز منتقل مي گردد يا خير؟ از آنجا كه داوري وجود خود را از توافق طرفين به عاريه مي گيرد، انتقال گيرنده صرفاً در صورت رضايت به پذيرش داوري، پايبند به آن است. ماهيت ويژه داوري سبب شده تا قانون گذار در ماده 481 قانون آيين دادرسي مدني به موجب حكمي استثنايي، داوري را در صورت فوت يا حجر يكي از طرفين، زائل و غيرقابل انتقال بداند. در اين پژوهش، پس از بررسي موضوع با شيوه تحليلي، اين نتيجه به دست آمده است كه موافقتنامه داوري، علي رغم حكم ماده 481 قانون آيين دادرسي مدني، در صورتي كه از جمله قراردادهاي شخصي نباشد، با احراز رضايت طرف ديگر عقد اصلي به انتقال قرارداد و رضايت انتقال گيرنده به داوري، قابل انتقال به شيوه قهري، تبعي و ارادي است.
