قدرت‌هاي بزرگ و نقض رژيم‌هاي بين‌المللي حقوق‌ بشر

The Great Powers and Violation of International Regimes of the Human Rights

«حقوق بشر» به مثابه حقوق طبيعي و اخلاقيات ريشه در وجدان بشريت دارد. كتاب‌هاي آسماني به ويژه قرآن كريم، آموزه‌هاي انبيا و صالحان، مباني اخلاقيات مبتني بر حقوق بشر نظير حقوق اساسي، آزادي و كرامت ذاتي انسان را به‌گونه شايسته‌اي ترسيم كرده‌اند. نظام جديد حقوق بشر بين‌الملل در واقع يك پديده بعد از جنگ جهاني دوم است كه در اثر نقض فاحش اصول اخلاقي توسط دولت‌هاي غربي، جنايات و فجايع ضدبشري جنگ‌هاي جهاني، كشتار دسته‌جمعي و نسل‌كشي (ژنوسايد) مطرح شده است. در اين پژوهش با استفاده از رهيافت رژيم‌هاي بين‌المللي، نقش قدرت‌هاي بزرگ به ويژه ايالات متحده آمريكا در تدوين اسناد حقوق بشر مورد نقد و بررسي قرار مي‌گيرد. قدرت‌هاي بزرگ گرچه در تدوين و ظهور رژيم‌هاي بين‌المللي دخيل‌اند، اما پس از تشكيل آن تلاش مي‌كنند هژموني خود را بر آن حفظ نمايند و اگر بخشي از آن مغاير با منافع ملي آن‌ها باشد آن را ناديده گرفته و يا از بين مي‌برند. در اين اثر براي پاسخ به سئوال اساسي پژوهش، پس از بررسي رژيم‌هاي حقوق بشري، تلاش مي‌شود موازين حقوق بشر اسلام را كه مشحون از معيارهاي انساني و اخلاقي است، به عنوان مباني اعلاميه جهاني حقوق بشر و اصول اساسي جمهوري اسلامي ايران، مورد تبيين قرار گيرد.

The human right as the natural law and ethics is rooted in human conscience. The divine books and in particular the holy Quran, the teachings of prophets and righteous have defined the foundations of morality as a solid base for the human rights, including the fundamental rights, freedom and dignity of the human being. The new international regimes of the human rights are in fact a post-world war II phenomenon which was created as a result of gross violation of human rights by Western countries, inhuman crimes and atrocities during the world wars, mass murder and genocide. The present article adopting the international regimes approach, aims to do a critical assessment of the role of great powers, in particular the United States, in creation of the human rights documents. The great powers, the author concludes, while contributing to the emergence of international regimes, try to preserve their hegemony on these regimes and to ignore or violate them if they deem it inconsistent with their interests. After evaluation of human rights regimes, the principles of Islamic human rights which are rich of human and moral elements are elaborated.
