تعهدات در قبال جامعه بين‌المللي و جايگاه آن در حقوق مسئوليت بين‌المللي دولت

Commitments of States toward the International Community as a Whole and its Role in International Responsibility of the State

ترديدي وجود ندارد جامعه بين‌المللي در راه رسيدن به قانونمندي و عدالت محتاج قواعدي است كه خارج از چارچوب تعهدات دو يا چندجانبه نسبت به تمامي اعضاي جامعه بين‌المللي قابليت اجرا و استناد داشته باشد. اين قابليت اجرا مستلزم اين است كه نسبت به نقض تعهدات اين‌ چنيني حقوق مسئوليت بين‌المللي لحاظ شود. طرح كميسيون حقوق بين‌الملل درخصوص مسئوليت بين‌المللي دولت‌ها براي اعمال متخلفانه بين‌المللي گرچه هنوز به هيأت يك معاهده بين‌المللي در نيامده است، كامل‌ترين سندي است كه تاكنون به مسئوليت بين‌المللي درخصوص تعهدات در مقابل جامعه بين‌المللي‌‌ ـ در كنار مسئوليت بين‌المللي نسبت به ساير تعهدات‌ ـ‌ پرداخته است. در اين نوشتار جايگاه تعهدات در مقابل جامعه بين‌المللي در حقوق مسئوليت بين‌المللي دولت مورد مطالعه قرار مي‌گيرد.

To reach to a society based on the rule of law and justice, the international community needs regulations that would be applicable to all members of international community, regardless of their bilateral or multilateral obligations and alliances. This applicability requires benign codification of the law of international responsibility. The draft of the United Nations International Law Commission (ILC) on "Responsibility of States for internationally wrongful acts", though is not yet an international treaty, is the most comprehensive document that concerns the international responsibility and the commitments of States toward international community as a whole. The present article aims to study the status of obligations toward international community within the framework of international law on responsibility of the State.
