The Role of Specific Brief in Cleaving the General Revisited

از جملة مسائل مطرح ميان اصوليان، تمسك به عام در صورت مجمل‌بودن دليل خاص است. در اين‌ باره شيوه متداول اين است كه تقسيماتي براي مسئله مطرح و تمام اين صورت‌ها را بررسي مي‌كند؛ اما در نوشتار پيش ‌رو، اين نظريه را مطرح كرده‌ايم كه پيش از بررسي صورت‌هاي مطرح‌شده، ابتدا بايد برخي مباني مؤثر در مسئله بررسي شود؛ زيرا پذيرش برخي مباني در علم اصول موجب مي‌شود در تمام صورت‌هاي مطرح‌شده، تمسك به عام را به‌صورت مطلق جايز بدانيم و بر اساس برخي ديگر، چنين تمسكي را جايز ندانيم. در صورت‌هاي مطرح‌شده، تفاوت فقط بر اساس برخي مباني معنا خواهد داشت؛ لذا طبق نظريۀ مختار، روش متداول در بررسي اين مسئله صحيح نيست و نيازمند بازنگري اساسي است.

Cleaving to the general in cases where specific reasoning is brief is regarded among the most important issues Osuli scholars have raised. The popular method for encountering this phenomenon is that several countenances for this issue are proposed and then all of these countenances are studied. This paper discussed the theory that before investigating the mentioned countenances, some fundamental principles should be examined, as confirming some principles in Osul science causes that cleaving to the general in all countenances is allowed unconditionally, while some others are not and the difference in the raised countenances is merely meaningful due to some basic principles. Therefore, the current method for investigating this issue seems not to be correct and demands a drastic revision.
