Criticism and Analysis of the Theory of Incitement on Incitement

گاه، برخي در برابر دريافت مزد، به انجام اعمال عبادي مبادرت مي­ ورزند. دريافت مزد با لزوم قصد قربت در انجام اعمال عبادي، به ظاهر ناهماهنگ است. فقيهاني كه اين گونه اعمال عبادي را صحيح مي­ دانند، در قالب نظريۀ داعي بر داعي(انگيزه قرب بر انگيزه مزد)، به تبيين استدلاليِ آن پرداخته­ اند. هر چند، ادبيات مكتوب فقه شيعه با اين نظريه، نا آشنا نيست، ولي بررسي نوشته­ هاي فقهي، تدويني را از اين نظريه، گزارش نمي دهد. از اين رو، نوشتار حاضر مي­ كوشد در پي پيشينه شناسي نظريه داعي بر داعي در ادبيات مكتوب فقه شيعه، با تبيين مبناي پيروان اين نظريه و بررسي نقدهايي كه منتقدان، بر اين نظريه، روا مي­ دارند، ضمن پاسخ­گويي به نقدها و نشان­ دادن ضعف آن­ها، صحت و استواري آن را بر پايۀ استدلال عقلي روشن ­سازد و كاركرد آن را در تحليل و توجيه مباحث معرفتي فقه عبادات نشان دهد.

Sometimes, one might perform act of worship in return for being paid. Apparently, asking for a wage for such an action is in contradiction with performing act of worship with the intention of winning God’s favor. The jurisprudents, who consider performing act of worship in this way, have approached this issue under the theory of incitement on incitement and have argumentatively stated such a theory. However, Shiite jurisprudence survey of literature is familiar with this theory, but investigating jurisprudential writings report no formulation of such a theory. Hence, by reviewing the written jurisprudential literature of this theory, the present paper attempts to explain the ideological basis the advocates of this theory believe and to investigate the criticisms the critics have raised with respect to this theory. Then, after responding and justifying these criticisms and referring to their weaknesses, the validity and stability of this theory are clarified, based on a rational argumentation. Likewise, its function is described by analyzing and justifying the epistemological issues of the act of worship jurisprudence.
