نگرشي نو در مفاد قاعده نفي سبيل و نسبت‌سنجي آن با اصل عدالت در روابط بين‌المللي

A New Look on the Purport of the "No Way Principle"; and Examining Its Connection to the Principle of Justice in the International Relations

يكي از مسائلي كه از آغاز موردِتوجه اسلام بوده، تنظيم اصول و قواعد ارتباطات انساني است. روابط ميان ملل مسلمان و غيرمسلمان بخشي از اين حوزۀ گسترده است. اين روابط براساس دلايل عقلي و نقلي برمدار اصولي چون «قسط» و «نفي سلطۀ كافر بر مسلمان» استوار است. دراين‌ميان، برخي فقيهان تلقي اثباتي از اصل «نفي سبيل» دركنار بُعد سلبي آن را با عنايت به برخي از مستندات نقلي آن همچون روايت «الإسلام يعلوا ولايعلي عليه» موردِتوجه قرار داده‌اند. ايشان بر اين باور شده‌اند كه تنظيم روابط بين‌المللي مسلمانان با اقوام و ملل غيرمسلمان بايد به‌گونه‌اي رقم زده شود كه همواره به برتري حقوقي مسلمان بر كافر بينجامد. به‌نظر مي‌رسد چنين خوانشي از قاعدۀ نفي سبيل با اصل قسط (يكي از پايه‌اي‌ترين اصول روابط بين‌الملل اسلامي) در تضاد است. اين مقاله بررسي ابعاد اين موضوع را برعهده گرفته و با اتخاذ رويكردي انتقادي دربرابر خوانش فقهي مذكور، تفسيري نو از قاعدۀ نفي سبيل ارائه كرده كه همسو با عدالت بين‌المللي است.

Conducting the principles of human relations is one of the subjects which has been highly noted from the first days of the advent of Islām. Obviously, Muslims—Non-Muslim's relations is part of this broad area. These relations supported by rational and narrative reasoning are based upon principles like "Justice" and "No-Domination for Unbelievers Over Believers (No Way Principle)." Some scholars, with regard to certain narrative arguments e.g. Islām's Supremacy have noted the positive side of this principle alongside the negative side. These scholars hold that codifying Islāmic international relations should be established in a manner that supremacy of Muslims preserves. It seems that this interpretation of the Principle of "No way" challenges the Principle of Justice as the most basic foundation of the Islāmic international relations. This essay, by criticizing the current juridical interpretation, and aligned with the concept of International Justice, presents a new interpretation of the "No Way Principle".
