Abstract :
The judiciary is an obligatory state institution in the Islamic world. It is an essential element for the implementation of justice. A truthful, incorruptible and just judicial system is clearly defined in the Qur an and Sunna. Many scholars have discussed exhaustively the theoretical and pratical issues concerning the judicial system using the appropriate Qur anic injunctions and the Sunna. The objective of the article is to clarify the meaning and legality of the Islamic judiciary system by highlighting the explicit textual rulings found in Qur an and Sunna. The command to establish the judicial system has its origins in authentic legal sources.
