A jurisprudential study of staying alone with the non-Mahram

چكيده گسترش روابط اجتماعي مسئله‌ي ارتباط زن و مرد نامحرم را پررنگ‌تر كرده است. اين ارتباطات گاهي موجب شكل‌گيري خلوت بين آنها مي‌شود. كسب آرامش و تعالي مادي و معنوي انسان مسلمان درگرو دريافت دستورات الهي در اين مسائل و سپس عمل به آن است. هدف از اين پژوهش بررسي فقهي– اجتهادي حكم شارع درباره‌ي خلوت زن و مرد نامحرم است. اطلاعات پژوهش به روش كتابخانه‌اي جمع‌آوري شده و به شيوه‌ي تحليلي- اجتهادي مورد تجزيه و تحليل قرار گرفته است. ادله تحريم اين مسئله شامل چند دسته روايات، شهرت فتوايي، سيره متشرعه و علت دانستن خلوت براي وقوع در حرام است. در مقابل به دليل ضعف سندي روايات، ضعف دلالت روايات بر حرمت خلوت، وجود روايات معارض و رد شهرت فتوايي، سيره‌ي متشرعه و حكمت بودن خلوت براي وقوع در حرام، ادله گروه اول را نقد كرده‌اند با اين وجود به‌دليل روايات متعدد همانند نظر بيشتر فقها، احتياط در ترك خلوتي است كه حضور يا نظارت ديگران وجود ندارد البته جايي كه خلوت مقدمه براي هر نوع كار حرامي باشد از باب ريبه يا مقدميت حرام است. كليدواژگان: فقه، خلوت، نامحرم.

Abstract The expansion of social relations has raised the issue of the relationship between non-Mahram men and women. These relationships occasionally create chance they should remain alone with each other. Only in the light of divine orders in these matters and then acting according to these rules, human can achieve peace of mind and ultimately and spiritual and material transcendence. The purpose of this research is to investigate the juridical rulings of privacy [seclusion] of unmarried women and men based on a. The research data were collected from library archive and the author has made use of jurisprudential-extrapolative method in analysis of his data. The reasons that it is religiously forbidden that two non-Mahram man and woman stay in private room, are many including the Quranic verses, a number of narratives and well-celebrated nature of the Islamic legal rulings of religious authorities. On the contrary, the second group have provided some counter arguments which are based on the weakness of narratives, the weak signification of narratives on the issue, the existence of contradictory stories, and the rejection of the fatwa s reputation by some jurists, taking preemptive measures in order not to fall in Harm acts. However, due to numerous traditions, it is in accordance with the caution not to stay lonely with a non-Mahram person. The major reason for this unlawful act is that one may fall in Harm or their private stay may be a prelude for committing sinful relationship.
