در صورت عدم اعتراض به رأي در مهلت قانوني و يا عدم امكان ابطال آن توسط دادگاه هاي ملي، به درخواست محكوم له از مراجع كشور محل صدور يا كشور ديگر، رأي در معرض شناسايي و اجرا قرار گرفته و اقدامات مربوط به آن ها معمول خواهد گرديد. در واقع آخرين مرحله جريان حل و فصل اختلافات بين المللي از طريق داوري، مربوط به شناسايي و اجراي رأي مي باشد. اجراي برخي آراء داوري به دليل آنكه محكوم عليه طوعا رأي را به اجرا در مي آورد نيازمند انجام عمليات اجرايي توسط مراجع دولتي نمي باشد. برخي نيز با ماهيت اجرايي ندارند با ذينفع رأي تنها خواهان به رسميت شناختن (شناسايي آن) مي باشد، در اينگونه موارد نيز رأي به اجرا نياز ندارد. اما در مواردي كه ماهيت آراء اجرايي است و محكوم عليه طوعا آن را اجرا نكند؛ به اقدامات اجرايي نياز خواهد بود و اين امر مستلزم دخالت مراجع مربوطه دولتي و به كارگيري قواي اجرا كننده مي باشد.

In fact, the last stage of the international dispute settlement process through arbitration is related to the recognition and implementation of the decision. The implementation of some arbitration decisions does not require execution operations by government authorities because the convicted person implements the decision voluntarily. Some are not executive in nature, the beneficiary of the vote only wants to recognize it, in such cases the vote does not need to be implemented. But in cases where the nature of the decisions is executive and the convicted person does not implement them voluntarily; Enforcement actions will be required And this requires the intervention of relevant government authorities and the use of executive powers.
