Abstract :
The breach of confidentiality of judicial proceedings is described as an offense against judicial bodies or courts in consideration of the importance to protect confidentiality in criminal judgment. This article examines the crime of breach of confidentiality regulated by the Article 285 of the Turkish Penal Code. Due to amendments made by the Law No: 6352 dated 02.07.2012 on judgmental services and amendments in the code related to deferring cases and punishments of crimes via press, these changes have been taken into consideration in this article. This article analyses the fundamental elements of the crime of breach of confidentiality which are the typicality, the objective elements, subjective elements and elements of unlawfulness.
