Abstract :
Commercial enterprise is the central notion of commercial law. Many concepts such as commercial regulation, commercial jurisdiction, business name, commercial agent, commercial registration are defined considering this notion. The new Turkish Commercial Code intended to settle disputes in the period of former Code No.6762 giving a definition of commercial enterprise; however, this definition is not appropriate. The equivocality arises from the preservation of article 15 and disharmony between article 11 and article 15 of the new Law. In my opinion, this problem can be solved by eliminating article 15 or aligning it with article 11 in the light of the conception of uncommercial enterprise is artisan enterprise.
