Abstract
In so far as a creditor of the company to which the obligation has been transferred in accordance with the draft terms of division has not obtained satisfaction, the recipient companies shall be jointly and severally liable for that obligation (Art. 176 of TCC No. 6102). But this liabilty is not limited. The subject of this study is explaining the said article and determining whether it is possible to limit the liability.
