Abstract :
Marketing agreement was not covered in the preceding Code of Obligations. However, in practice, it was known to be a type of service agreements. The marketer constantly assumes to intermediate on each transaction of the employer outside the company and on behalf of the employer. In case if there is any written agreement, the marketer shall carry out the transactions designated in this agreement on behalf of the employer, and the employer shall undertake to pay wages in return. Marketer shall advertise and intermediate the services rendered at the company so as to be sold to customers who are in remote locations outside of the center. For this reason, marketer is also defined as deputy merchant who operates on behalf of merchant outside the company and who is associated to the merchant with service relationship.
