Right to Counsel Under European Convention on Human Rights (Art. 6/3-c)

Right to counsel which is connected with the right of defence and equality of arms is generally regarded as a constituent of the right to a fair trial. In this study, we deal with the right to counsel which is guaranteed under European Convention on Human Rights. This study composes of three part: Firstly, we try to show reasons why a counsel is necessary for a fair trail. Secondly, the right to counsel will be explained within the scope of ECHR Art.6/3-c, allowing for the defendant to choose a counsel and to be assisted by him, and if he cannot afford his own lawyer, requiring that the government is obliged to appoint a free counsel for him/her. At the end of the study, we discuss several points in relation to the Turkish Criminal Procedure System.
