Influence of the parliament deputy statute on suspension and interruption of statute of limitations related public action and punishment against the 83rd article of Turkish Constitution
Abstract :
The suspension cause situated in the 83rd article of Turkish Constitution is about exclusively statute of limitations of punishment. In the cases concerning deputies of parliament, statute of limitations (of public action) can be suspended merely by requesting revocation of immunity. At this juncture, the legal practice in the direction of making criminal investigation and starting the prosecution depends on revocation of immunity, causes serious problems. However criminal investigation about deputy must be done and prosecution must be started. After the initiation of prosecution, to make suspend statute of limitations by applying to TGNA, will be the most suitable mean.
