Crime of Extortion in the Framework of the Amendments of the Act Number 6352 (Turkish Penal Code Art. 250)

The crime of extortion is organized in the Turkish Penal Code No. 5237, article 287. İn the first paragraph of article extortion by compel is regulated. Extortion by convince stated in the second paragraph and in the third paragraph of article, extortion by taking an advantage of a person’s mistake is regulated.By the act no.6352 and date 02.07.2012, a new sentence added in the first paragraph of the article named as presumption of compel and the scope of concept of compel is expanded. Some offences which are in the scope of the crime of “Misuse of Public Duty (art. 257)” before, now regulated as extortion of compel with this amendment. In this study, the concept of compel, convince, taking advantage of a person’s mistake and presumption of compel will be examined. Also, some of the problems caused by applications in the legal regulation and will also be evaluated daily.
