Abstract :
One of the most comprehensive European harmonization projects of the Digital Age is the EU privacy regulation, which will reform and unify the applicable data protection legislation in Europe. While Europe is in the process of defining its DP standards with a new vision, Turkey is defining its own DP standards. Actually over the last eleven years, Turkey has taken some small steps towards a new legal basis for privacy issues. The core of these efforts is the Draft Data Protection Act, which actually is based on the directive 95/46 and finally by the end of 2014 made its way to the parliament. But because of the recent general elections in June 2015 the draft act became invalid. At this stage, where Turkey is officially a candidate country, and the accession negotiations between EU and Turkey are still in an ongoing process, it is more than important to introduce the European level of DP standards in Turkey. But the question if this is actually the case for the recent Draft DPA is easy to answer. The regulation has not been enacted on EU level so far, therefore the Ministry of Justice and Prime Ministry, which leaded the preparation of the Draft DPA during the past legislative term did not consider the EU data protection reform. This article aims to point out the main innovations and changes of future DP in the EU.
