Surname of woman in French, German, Swiss and Turkish law
Abstract :
The effect of marriage on the surname of woman is one of the highly controversial topics in law. Taking the surname of the other spouse is accepted as a typical conclusion of marriage in legal systems which adopt the principle of the unity of family name. As it is regarded as tradition for wives to take a man’s name after marriage, when she gets married she has no choice about her surname. On the other hand, recent developments which take form specially by the effects of judgments of the European Court of Human Rights have shown that the idea of equality of women and men takes precedence over any other considerations.
