Abstract
According to HMK Art. 33 judge has to reinforce law ex officio. But considering the principal of introducing trail pieces by parties, parties have to introduce facts and evidences by themselves. Burden of proof belongs to party who acquires a right by proving the existence of the fact. The party who has burden of proof also faces to the danger of losing the trial.
