Abstract :
The reputation right in networks, as a new human right, is derived from Internet. Starting with an introduction to its definition, this article studies the problem of recognizing subjects of the right on the basis of three different types of parties in the virtual world, i.e. game player, screen name and real name, and puts forward that the real person represented by his virtual ID in cyber world, such as Sister Lotus, is the subject of the reputation right in networks. Furthermore, based on an analysis of the issue of recognizing the subject responsible from perspectives of personal tort, service provider tort and public tort, as well as the characteristics of different tortuous disputes, this article proposes some new countermeasures such as expanding the category of the term "definite defendant", granting more legal authority to the network supervision division for better rights advocation, and making online application for tort investigation etc.
