Abstract :
The concept of the economic loss doctrine in the U.S. courts is discussed in relation to successful and failed litigations relating to data storage environment. The discussion is illustrated by referencing latest data breach litigations. Various failed and successful data breach cases are classified and discussed. The paper also analyzes reasons why litigations have failed to address negligence of data storage providers associated with data security. The findings presented in the paper show that successful litigations are in most cases instigated by Attorney Generals of the states of the U.S.A, while there are only few cases instituted by the data storage provider or customers that have made it through court decision without being finally dismissed.
