  • Abstract
    Software industry as a soul and core of the information industry plays a vital role in the development of the world economy. China\´s present judicial situation of protection of intellectual property rights to software did not achieve the desired effect and piracy of software is prevalent. New Regulations on Computer Software Protection has narrowed the scope of fair use of original "Regulations" to the study or research of professional and technical personnel in computer software and extends the infringement boundary to end user. This paper discusses the fair use legal system of software enduser by the theory of fair use system, combined with China\´s Copyright Law and certain judicial interpretations, and legislative experience of several countries to expand appropriately, reduce software piracy and improve the development level of software industry.
