Revision of the construction project contract model text in China

The current construction project contract model text can no longer adapt to the changes of Chinese engineering market circumstances, so the Ministry of Housing and Urban-Rural Development (MOHURD) decided to revise the existing contract. The authors´ research team undertook the preparation of new version contract conditions. This paper analyzes the existing defects in the current construction project contract model, points out that revision is necessary. This paper puts forward four basic principles of the revision work, including (i) reflecting the latest achievements of legislation in the construction field; (ii) drawing on international contract standards; (iii) being coordinated with project management cost reform, and; (iv) protecting the sub-contractors and labors´ rights. In the last part of the article, the author analyzed the possible problems in the implementation process of the new contract.
