بررسي فقهي «تشبيب» از ديدگاه فريقين

امروزه، رفاقت‌هاي نامشروع زنان و مردان در كشورهاي اسلامي رايج شده و به تبع آن اشعار بسياري در توصيف زن و عشق به او سروده شده و در رسانه‌ها پخش مي‌شوند. اين فرهنگ، خلاف توصيه‌هاي شريعت به عفاف است. اين موضوع (تشبيب) گرچه در آثار علماي متأخر چون شيخ انصاري اشاره شده است، ولي به منظور پيشگيري از ابتذال نياز به تبيين و روشنايي حواشي آن در جامعه­ ي امروز، احساس نياز مي‌شود. شيخ انصاري در مكاسب با عنوان «تشبيب المرأة» عنوان شده است. از حاصل اين پژوهش مي‌توان دريافت كه حكم اوليه­ ي تشبيب از ديدگاه فقها حليت است، اما به دلايل ديگري چون تهييج شهوت، ترويج فحشا، هتك حرمت زن و... حرام است. فقهاي اهل سنت ساختن شعر يا نثر در تشبيب زن معروف را حرام امّا روايت آن را مشروط به عدم ايذاء و هتك حرمت زن و محارمش، مباح دانسته‌اند، لذا فقهاي فريقين در اين موضوع اختلافات و اشتراكاتي دارند.

Today, wrongful camaraderie between women and men is common in Muslim countries, and as a result many poems are written in the description of woman and love for her and they are broadcast in the media.This culture is chastity contrary to the sharia recommendations. This theme (tashbib), although mentioned in the works of later scholars such as Sheikh Ansari,But in order to prevent vulgarity, the need for clarification and the clarity of its margins in today's society are felt. Sheikh Ansari has been nominated as "tashbib al-marea".From this study it can be concluded that the initial sentence of tashbib is solvent from the point of view of jurisprudents. But for other reasons, such as the stimulation of lust, the promotion of prostitution, the abuse of a woman, and ... is forbidden. The Sunni jurisprudents have considered the creation of poetry or prose in the formulation of the famous woman as a forbidden, but the narrative is based on the failure to harass and condemn the woman and her condemned, so the jurisprudents of the conflict in this issue have differences.
