بررسي تحليلي تضمينات آزادي اقتصادي در نظام حقوق عمومي ايران ( با تأكيد بر برنامه هاي پنج ساله توسعه اجتماعي، فرهنگي و اقتصادي )

An Analysis of Guarantees of Economic Freedom in Iran’s Public Law System, with Emphasis on the Five-Year Social, Cultural an‎d Economic Development Plans

امروزه توسعه يافتگي كشورها با شاخص آزادي اقتصادي ارزيابي مي‌گردد.در اين مقاله، تضمينات آزادي اقتصادي در نظام حقوق عمومي ايران با تحليل و بررسي اصل 44 قانون اساسي، قانون سياست‌هاي كلي اصل 44، قوانين برنامه اول تا ششم توسعه و بهره‌گيري از روش توصيفي-تحليلي مطرح شده است و نتايج اين بررسي حكايت مي‌كند كه قوانين مرتبط با آزادي اقتصادي داراي كاستي‌هاي عديده‌اي از قبيل كارايي و تناسب در حوزه حاكميت قانون هستند.علاوه برآن بدفهمي‌ها و برداشت‌هاي نادرست از مفهوم خصوصي‌سازي، سياست‌هاي رقابتي را به عنوان تضمين‌كننده آزادي اقتصادي در مرحله تفسير و اجرا با ابهامات جدي مواجه نموده است.همچنين، مالكيت به عنوان يكي از اصول كلاسيك حقوق اقتصادي عمومي و رابطه حمايتي آن با تضمينات آزادي اقتصادي، در نظام حقوق عمومي ايران مغفول مانده و امكان سلب مالكيت به منظور حفظ منافع عمومي بدون پرداخت غرامت در قانون اساسي نيز، تضمينات آزادي اقتصادي را با چالش اساسي روبه رو كرده است.پژوهش حاضر با رويكرد فوق‌الذكر به ارائه راهكار لازم در خصوص كاستي‌هاي فوق خواهد پرداخت.

Today, the development of countries is measured by the index of economic freedom. This paper uses a descriptive-analytical method to analyze the guarantees of economic freedom in the Iranian public law system through focusing on article 44 of the Constitution,the enforcing general policies of article 44 of the constitution and the laws of the First to Sixth Development Palns. The research results show that the regulations related to economic freedom suffer from numerous shortcomings, such as efficiency and proportionality in the rule of law. In addition, misunderstandings and misconceptions about the concept of privatization have adversely affected the competition policies, as a potential guarantee of the economic freedom, and left them to open interpretation. Also, coupled with the possibility of expropriation in order to maintain the public interests without compensation in the Constitution, ownership, as one of the classical principles of public economic rights and its supportive connection with the guarantees of the economic freedom, is being neglected in Iran's public law system. The present study will provide viable solutions to address the mentioned shortcomings.
