چكيده فارسي :
زمينه و هدف: از زمان تدوين منشور ملل متحد كرامت انساني تاثير مهمي در ابعاد مختلفِ هنجارهاي حقوق بشري داشته است. به خصوص محاكم داخلي و بين المللي همواره براي تفسير حق هاي بشري و توسعه آنها به كرامت انساني بعنوان مبناي حقوق بشر تمسك جسته اند. از جمله حق هاي بشري كه محاكم بين المللي براي آن مبناي كرامتي در نظر گرفتند حق بر سلامتي و مراقبه هاي پزشكي مي باشد. در همين راستا در اين مقاله بدنبال پاسخگويي به اين سوال هستيم كه مبناي حق بر سلامتي بعنوان يك حق بشري چيست و وراي نقش مبنايي چگونه مي تواند عملا به هنجارسازي در اين حق بپردازد.
روش بررسي: در اين مقاله از روش تحليلي و توصيفي جهت گرداوري مطالب و نگارش آن استفاده شده است كه اين موارد در راستاي هدف اين پژوهش كه تبيين ارتباط ميان كرامت انساني و حق بر سلامت مي باشد صورت پذيرفته است. در اين راستا ابتدا كرامت انساني تعريف سپس جايگاه آن بعنوان مبناي حقوق بشر تبيين مي گردد. متعاقبا تاثير هنجاري كرامت انساني بر حق بر سلامت در پرتو اسناد بين المللي و رويه قضائي مورد توجه قرار خواهد گرفت.
يافته ها: بي ترديد هر نظام حقوقي نيازمند مبنايي نظري است و كرامت انساني مبناي حقوق بشر در نظام مدرن مي باشد. كرامت انساني با اثرگذاري بر حق بر سلامت بعنوان يك حق بشري، نه تنها چهارچوب هاي نظري آن را مشخص مينمايد بلكه با تفسير موسع قادر به هنجارسازي و توسيع اين حق بشري است.
نتيجه گيري: با بررسي اسناد و رويه قضايي مشخص مي شود كه مبناي حق بر سلامت نه صرفا بقاي بشر، بلكه كرامت ذاتي وي مي باشد. مبناي كرامتي حق بر سلامت محاكم قضايي را قادر مي سازد تا با استفاده از ابزار تفسير وضعيت هاي بيشتري را ذيل حق بر سلامتي و مراقبه هاي پزشكي مورد حمايت قرار دهند.

Background and Aim: This study attempts to answer the question of what constitutes the right to health as a
human right and how it can practically help to normalize this right.
Materials and Methods: In this analytical study, firstly, the definition and position of human dignity as the
basis of human rights are explained. Subsequently, the normative impact of human dignity on the right to
health will be addressed and analyzed in the light of international documents and judicial procedure.
Findings: The link between human dignity and human rights can be explored in different ways. Historical
origin, theoretical derivation, interpretive approach, and source of legitimacy are the components that explain
the relationship between human dignity and human rights. Undoubtedly, every legal system needs a
theoretical basis; international documents and judicial procedure show that human dignity, by affecting the
right to health as a human right, not only is the source of its legitimacy and specifies its theoretical
framework but, it is capable of standardizing and expanding it through extensive interpretation. Today, the
right to health encompasses a wide range of human rights, including the right to safe drinking water and
food, healthy environmental and occupational conditions, access to health information and education as well
as health care.
Conclusion: The findings show that the basis for the right to health is not merely human survival but
inherent dignity of man. This foundation of the right to health enables judicial bodies to use this tool to
support more conditions under the right to health and health care.
