Political-Legal Pathology of Acts Related to Sports and Physical Education in the national consultative assembly of the Second Pahlavi Era

هدف اين پژوهش تحليل قوانين مرتبط با امور ورزش و تربيت بدني در عهد پهلوي دوم بر مبناي قانونگذاري خوب است. در اهميت و ضرورت پژوهش قابل توجه است كه نخبگان ايران پس از انقلاب مشروطيت سعي در نهادينه و محدودسازي نظام سياسي به قانون بودند، اين مهم در عرصه هاي گوناگون از جمله تربيت بدني و ورزش به عنوان گسترده‌ترين پدپده اجتماعي عصر حاضر در مجالس ادوار پهلوي دوم به چشم مي خورد. لذا اين پژوهش با رويكرد كيفي انتقادي مي كوشد احكام و قوانين ورزشي مصوب مجلس شوراي ملي، از سال 1320 تا 1357 ش را براساس فرآيند «قانونگذاري خوب» تحليل نمايد. روش تحقيق تاريخي با بررسي اسناد است. طبق رويه هاي «قانونگذاري خوب»، قانونگذاري فرايندي است كه گرچه در صلاحيت قوه مقننه است، اما مستلزم همكاري ساير قوا، به ويژه قوه مجريه مي باشد و براساس معيارهاي قانونگذاري خوب، مصوبات پارلمان بايد به لوايح قوه مجريه متكي باشند. نتايج نشان داد كه تمام قوانين ورزشي مصوب در عهد پهلوي دوم لايحه محور است كه اين روند به رغم انطباق با اصل حاكميت قانون، احتمالا ناشي از چالش تفكيك قوا مي باشد و حاكي از حكمراني استبداد خودكامه و دست نشاندگي قواي مجريه و مقننه توسط دربار است. قوانين مرتبط به برگزاري بازي هاي آسياي 1974 تهران كه بزرگترين رويداد ورزشي معاصر كشور است، احتمالا حاصل همراستايي اركان سياسي كشور باشد. پيشنهاد مي شود در گام دوم انقلاب اركان سياسي نظام بدين گونه براي دستيابي به ميزباني رويداد هاي ورزشي منطقه اي و بين المللي بسيج شوند.

Therefore, this research with a critical qualitative approach examine the principle of Legislative formalities from the principles of good legislation, while analyzing the trend and orientation of legislative policies from the second Pahlavi era with emphasis on the main components of sports development in the modern world. The results showed that all sports laws adopted in the second Pahlavi era are bill-oriented, which, despite compliance with the Good Legislation (Legislative formalities (, is probably due to the challenge of separation of powers and indicates the absolute rule of the second Pahlavi in Legislative system. In addition, most of the legislative policies on the subject of sports are about the development of educational, public and recreational and championship sports, and little attention is paid to the development professional sports. This imbalance in the legislative policies of the sport has led to the backwardness of the Iranian sports industry.
