The Impact of Intelligence Aristocracy on Confiscation of Drug Traffickers' Property with Emphasis on Organized Crime (Case Study of Kermanshah Province)

اﺷﺮاف اﻃﻼﻋﺎﺗﯽ ﯾﮑﯽ از ﻧﯿﺎزﻫﺎي اﺳﺎﺳﯽ و ﺑﻨﯿﺎدي و از ارﮐﺎن اﺻﻠﯽ و ﺿﺮوري ﻣﻮﻓﻘﯿﺖ در اﻣﻨﯿﺖ و ﺗﺤﻘﻖ ﺟﺎﻣﻌﻪ اﻣﻦ ﻣﯽ ﺑﺎﺷﺪ. ﺑﺮاﯾﻦ اﺳﺎس دﺳﺘﯿﺎﺑﯽ ﺑﻪ اﺷﺮاف اﻃﻼﻋﺎﺗﯽ ﻧﯿﺎزﻣﻨﺪ ﺳﻠﺴﻠﻪ اﻗﺪاﻣﺎﺗﯽ اﺳﺖ ﮐﻪ ﺑﺎ رﺻﺪ آن ﻣﻮﺟﺐ ﻣﯽ ﺷﻮد درﮐﺴﺐ اﺧﺒﺎر و اﻃﻼﻋﺎت و اﺣﺎﻃﻪ و اﺷﺮاﻓﯿﺖ ﺑﺮ ﺗﺤﺮﮐﺎت و ﻓﻌﺎﻟﯿﺖ ﻫﺎي ﻗﺎﭼﺎﻗﭽﯿﺎن و ﻣﺼﺎدره اﻣﻮال آﻧﺎن ﻣﯽ ﺑﺎﺷﺪ .در اﺟﺮاي ﺑﻨﺪ ﻫﺎي 1 و 2 ﺳﯿﺎﺳﺖ ﻫﺎي ﮐﻠﯽ ﻣﺒﺎرزه ﺑﺎ ﻣﻮاد ﻣﺨﺪر و ﻧﻈﺮ ﺑﻪ اﯾﻨﮑﻪ ﯾﮑﯽ از ﮐﺎرآﻣﺪﺗﺮﯾﻦ و ﺑﺎزدارﻧﺪه ﺗﺮﯾﻦ ﺷﯿﻮه ﻫﺎي ﻣﺒﺎرزه ﺑﺎ ﻣﻮاد ﻣﺨﺪر ، وارد ﻧﻤﻮدن ﺿﺮﺑﻪ ﺑﻪ ﺑﻨﯿﺎن ﻫﺎي اﻗﺘﺼﺎدي ﺷﺒﮑﻪ ﻫﺎي ﺗﻬﯿﻪ و ﺗﻮزﯾﻊ ﻣﻮاد ﻣﺨﺪر ، ﺷﻨﺎﺳﺎﯾﯽ و ﻣﺼﺎدره اﻣﻮال آﻧﺎن ﻣﯽ ﺑﺎﺷﺪ . در دﻧﯿﺎي اﻣﺮوز، رﻣﺰ ﻣﻮﻓﻘﯿﺖ در ﻋﺮﺻﻪ ﻫﺎي ﻣﺨﺘﻠﻒ، ﺑﺮﺗﺮي اﻃﻼﻋﺎت و اﺳﺘﻔﺎده ﺻﺤﯿﺢ ازآن اﺳﺖ. اﻣﺮوزه ﺑﺎﻧﺪﻫﺎي ﻣﻮاد ﻣﺨﺪر ﺑﺎ اﻗﺪاﻣﺎت ﻣﺠﺮﻣﺎﻧﻪ ﺳﻮدﻫﺎي ﺳﺮﺷﺎري را ﺑﻪ دﺳﺖ ﻣﯽ آورﻧﺪ و اﯾﻦ اﻣﺮ ﯾـﮏ ﺗﻬﺪﯾﺪ ﺟﺪي ﺑﺮاي ﮐﺸﻮر ﻣﺤﺴﻮب ﺷﺪه و ﻣﯽ ﺗﻮاﻧﺪ دﺳﺘﮕﺎه ﻫﺎي ﺳﯿﺎﺳﯽ، اﻗﺘﺼﺎدي و ﻓﺮﻫﻨﮕﯽ ﮐـﻼن ﮐﺸـﻮر را ﺗﺤﺖ ﺗﺄﺛﯿﺮ ﻗﺮار داده و ﺳﭙﺲ ﺑﻪ ﻣﺮور ﺑﻪ ﻋﻨﻮان ﯾﮏ ﻣﻨﺸﺄ ﺗﻬﺪﯾﺪﮐﻨﻨﺪه اﻣﻨﯿﺖ ﻣﻠﯽ در ﮐﺸﻮر ﺗﺒـﺪﯾﻞ ﺷـﻮد. اﻧﺠـﺎم ﺗﺤﻘﯿﻘﺎت و ﭘﮋوﻫﺶ ﻫﺎي ﻋﻠﻤﯽ ﺟﻬﺖ اﻧﺘﺨﺎب راه ﻫﺎي درﺳﺖ و ﻋﻠﻤﯽ و اﺗﺨﺎذ ﺗﺪاﺑﯿﺮ ﻣﺆﺛﺮ ﺟﻬﺖ ﻣﻘﺎﺑﻠﻪ ﺑﺎ اﯾـﻦ ﭘﺪﯾﺪه ﺷﻮم ﺑﺴﯿﺎر ﺣﺎﺋﺰ اﻫﻤﯿﺖ ﻫﺴﺖ. ﻟﺬا ﺑﺎ اﻧﺠﺎم اﯾﻦ ﭘﮋوﻫﺶ ﻣﺸﮑﻼت و ﻧﺎرﺳـﺎﯾﯽ ﻫـﺎي اﯾـﻦ ﺣـﻮزه ﺑﯿﺸـﺘﺮ ﺷﻨﺎﺧﺘﻪ ﻣﯽ ﺷﻮد و ﺗﺤﻘﯿﻖ ﺣﺎﺿﺮ ﺑﺎﻫﺪف ﺑﺮرﺳﯽ ﺗﺎﺛﯿﺮ اﺷﺮاف اﻃﻼﻋﺎﺗﯽ در ﻣﺼﺎدره اﻣﻮال ﺣﺎﺻـﻞ از اﻋﻤـﺎل ﻣﺠﺮﻣﺎﻧـﻪ ﻗﺎﭼﺎﻗﭽﯿﺎن ﺟﺮاﺋﻢ ﻣﻮاد ﻣﺨﺪر ﺻﻨﻌﺘﯽ و ﺳﻨﺘﯽ، ﭘﯿﺶ ﺳﺎزﻫﺎ و روان ﮔﺮدان ﻫﺎ ﺑﺎ ﺗﺎﮐﯿﺪ ﺑﺮ ﺟﺮاﺋﻢ ﺳﺎزﻣﺎن ﯾﺎﻓﺘﻪ در اﺳﺘﺎن ﮐﺮﻣﺎﻧﺸﺎه اﻧﺠـﺎم ﮔﺮدﯾـﺪه اﺳﺖ؛ اﯾﻦ ﺗﺤﻘﯿﻖ ازﻧﻈﺮ ﻧﻮع ﺗﺤﻘﯿﻖ ﮐﺎرﺑﺮدي و ﺑﺮ اﺳﺎس ﻣﺎﻫﯿﺖ و روش، ﮐﯿﻔﯽ و ﺑـﺮاي ﮔـﺮدآوري دادﻫـﺎ از روش دﻟﻔﯽ و ﻣﺼﺎﺣﺒﻪ ﺑﺎ ﺧﺒﺮﮔﺎن اﺳﺘﻔﺎده ﺷﺪه اﺳﺖ. ﺟﺎﻣﻌﻪ آﻣﺎري ﺷﺎﻣﻞ ﺗﻌﺪاد ﭘﺎﻧﺰده ﻧﻔﺮ از ﺧﺒﺮﮔﺎن و ﻣﺘﻮﻟﯿﺎن اﻣﺮ ﻣﺒﺎرزه ﺑﺎ ﻣﻮاد ﻣﺨﺪر در اﺳﺘﺎن ﮐﺮﻣﺎﻧﺸﺎه ﻣﯽ ﺑﺎﺷﻨﺪ و ﻧﻤﻮﻧﻪ ﮔﯿﺮي از ﻧﻮع ﺗﻤﺎم ﺷﻤﺎر ﻣﯽ ﺑﺎﺷﺪ. ﻧﺘـﺎﯾﺞ اﯾـﻦ ﺗﺤﻘﯿـﻖ ﻣﺸﺨﺺ ﻧﻤﻮد ﮐﻪ ﺑﺎ اﺷﺮاف اﻃﻼﻋﺎﺗﯽ و اﻧﺠﺎم ﺻﺤﯿﺢ و دﻗﯿﻖ ﻣﺼﺎدره اﻣﻮال ﺣﺎﺻﻞ از اﻋﻤﺎل ﻣﺠﺮﻣﺎﻧﻪ و ﻗﺎﭼﺎق ﻣـﻮاد ﻣﺨـﺪر و ﭘـﯿﺶ ﺳﺎزﻫﺎ ﻣﯽ ﺗﻮاﻧﺪ ﯾﮑﯽ از روش ﻫﺎي ﺧﻮب ﻣﺒﺎرزه ﻫﻤﻪ ﺟﺎﻧﺒﻪ ﺑﺎ ﺟﺮاﺋﻢ ﺳﺎزﻣﺎن ﯾﺎﻓﺘﻪ ﻣﻮاد ﻣﺨﺪر و ﺳﺎﯾﺮ ﺟﺮاﺋﻢ ﻣﺎﻧﻨﺪ ﭘﻮل ﺷﻮﯾﯽ و ﺗﺮورﯾﺴﻢ ﺑﺎﺷﺪ. اﮔﺮ ﺷﻨﺎﺳﺎﯾﯽ اﻣﻮال و داراﺋﯽ ﻫﺎي ﻗﺎﭼﺎﻗﭽﯿﺎن ﺑﻪ درﺳﺘﯽ اﻧﺠﺎم ﺷﻮد ﻣﯽ ﺗﻮان ﺑﺎ اﻋﻤﺎل ﻗﻮاﻧﯿﻦ ﻣﺮﺑﻮﻃﻪ و ﺗﻮﻗﯿﻒ آن ﻫﺎ ﺿﺮﺑﺎت ﺟﺒﺮان ﻧﺎﭘﺬﯾﺮي ﺑﺮ ﭘﯿﮑﺮه ﻗﺎﭼﺎق ﻣﻮاد ﻣﺨﺪر، ﭘﯿﺶ ﺳﺎزﻫﺎ و روان ﮔﺮدان ﻫﺎ وارد ﻧﻤﻮد.

-Information aristocracy is one of the basic needs and one of the main and essential pillars of success in security and the realization of a secure society. Accordingly, access to intelligence aristocracy requires a series of measures, the observation of which leads to the acquisition of news and information and the encirclement and aristocracy over the movements and activities of traffickers and the confiscation of their property. Drugs and considering that one of the most effective and deterrent ways to fight against drugs is to hit the economic foundations of drug supply and distribution networks, identify and confiscate their property. In today's world, the key to success in various fields is the superiority of information and its proper use. Today, drug gangs make huge profits through criminal acts, and this is a serious threat to the country and can affect the political, economic and cultural institutions of the country and then gradually as a threatening source. Transform national security in the country Conducting scientific researches and researches to select the right and scientific ways and take effective measures to deal with this ominous phenomenon is very important. Therefore, by conducting this research, the problems and shortcomings of this field are better known and the present study aims to investigate the impact of intelligence aristocracy on confiscation of property obtained from criminal acts of industrial and traditional drug traffickers, precursors and psychotropics with emphasis on organized crimes. Has been done in Kermanshah province; This research is in terms of the type of applied research and based on the nature and method, quality and for data collection, Delphi method and interviews with experts have been used. The statistical population includes fifteen experts and those in charge of counter-narcotics in Kermanshah province and the sampling is of the whole type. The results of this study showed that with intelligence aristocracy and the correct and accurate confiscation of property resulting from criminal acts and trafficking in narcotics and precursors can be one of the good methods of comprehensive fight against organized crime and other crimes such as money laundering and Be terrorism. If the property and assets of traffickers are identified correctly, irreversible blows can be inflicted on the body of drug traffickers, precursors and psychotropics by enforcing the relevant laws and confiscating them.
