Investigating Unauthorized Foreign Operations in Afghanistan from the Perspective of International Law

زمينه وهدف:افغانستان به عنوان دولت حائل ميان روسيه و اقيانوس هند و راه ترانزيت كالا از جنوب آسيا به آسياي مركزي و اروپا از ديرباز در نظريات ژئوپلتيك اهميت ويژه‌اي داشته به طوري كه مورد توجه قدرت‌هاي زمان بوده است ودر طول تاريخ خود بارها به بهانه هاي مختلف مورد تهاجم دولتهاي بيگانه قرار گرفته ودراثر اين تهاجمات حوادث فاجعه باري در طي دهه هاي اخير در اين كشور رخداده است از جنگهاي سه گانه با انگلستان گرفته تا هجوم وحضور حدود يك دهه اي ارتش سرخ شوروي سابق ودر نهايت حمله و لشكركشي ايالات متحده آمريكا پس از حادثه 11سپتامر2001به بهانه مبارزه با تروريسم ،تمام اين اقدامات باعث به چالش كشيده شدن قوانين ومقررات حقوق بين المللي شده ضمن اينكه برخي دولتها وسازمانهاي بين المللي نيز با واكنشهاي نامناسب باعث زير سئوال رفتن هويت برخي سازمانهاي بين المللي شده است. هدف تحقيق پيش رو بررسي عمليات غير مجاز نظامي دول خارجه به ويژه آمريكا در افغانستان از منظر حقوق بين الملل و بيان وقواعد نقض شده بين المللي است. روش: تحقيق باروش، توصيفي انجام شده است. نتيجه حاصله بيانگر اين موضوع است كه حادثه مذكور در آمريكا بهانه اي شد تااين كشور اين بار به بهانه مقابله با تروريسم به كشور افغانستان لشكر كشي كه نه تنها اين اقدام مبارزه با تروريسم نبود بلكه در طي دو دهه اخير باعث بروز مشكلات فرا واني براي اين كشورازجمله تلفات غيرنظاميان ،افزايش ناامني،افزايش كشت وقاچاق مواد مخدر،تبديل افغانستان به آزمايشگاه تسليحاتي آمريكا ومهمتر گسترش تروريسم شده است.

Background and Objectives: Afghanistan as a buffer state between Russia and the Indian Ocean and the transit route of goods from South Asia to Central Asia and Europe has long been of special importance in geopolitical theories as it has been considered by power and throughout its history under various pretexts. Foreign invasions and catastrophic events in recent decades have taken place in the country, from the three wars with Britain to the invasion and presence of the former Soviet Red Army for almost a decade, and finally the US invasion and campaign after 9/11 under the pretext of 9/11. The fight against terrorism. All actions have challenged the laws and regulations of international law. In addition, some governments and international organizations have questioned the identity of some international organizations with inappropriate reactions. The purpose of the investigation is to examine the unauthorized military operations of foreign states, especially the United States, in Afghanistan from the perspective of international law and the expression and violation of international rules. Research method: Descriptive.As a result, the incident in the United States became an excuse for the country to invade Afghanistan under the pretext of counterterrorism, which not only did not counteract terrorism, but also caused significant problems for Afghanistan over the past two decades, including civilian casualties and increased insecurity. The increase in cultivation and drug trafficking has become an arms laboratory and the spread of terrorism.
