The Right of Animals to Life from the Perspective of Narrations

حقوق حيوانات به‌ويژه حق حيات و حفظ نسل آن­ها از مباحث مهم جوامع بشري است و با توجه به نقش حيوانات در بقاي محيط زيستِ مناسب انساني، اهميت آن افزايش مي­يابد. گاهي اين حقوق توسط برخي به‌عنوان بيان نقص شرع اسلام با اهداف غير علمي و بيشتر فرهنگي و سياسي طرح مي‌گردد و اين در حالي ­است كه پيشينۀ حمايت قانوني و عملي اسلام بسيار مقدم بر ساير مكاتب مي‌باشد. در اين جستار با بررسي آيات، روايات و متون فقهي مرتبط و با روش توصيفي - تحليلي به تبيين و بررسي ادلۀ حق حيات حيوانات و حفظ و حمايت از آن‌ها پرداخته شده است. برآمد تحقيق نشان­دهنده حمايت همه‌جانبۀ قوانين شرعي از اين حق بوده و در اين پژوهش، حمايت­هاي مادي، مانند حق معاش، تغذيه، بهداشت، اقامتگاه و غيره و حمايت­هاي معنوي مورد تاكيد قرار گرفته و از افتخارات اسلام بيان اين حقوق توسط امام علي(ع) در منشور حكمراني است.

Animal rights, especially the right to life and the preservation of their generation, are important issues in human societies, and their importance increases due to the role of animals in the survival of a suitable human environment. Sometimes these rights are proposed by some as an expression of the flaws of Islamic law with unscientific and more cultural and political purposes, while the background of legal and practical support for Islam is far ahead of other schools. In this article, by examining the verses, narrations and related jurisprudential texts and by descriptive-analytical method, the arguments of the right to life of animals and their preservation and protection have been explained. The results of the research indicate the comprehensive support of this right by the sharia law and in this research, material support, such as the right to livelihood, nutrition, health, residence, etc. and spiritual support are emphasized and it is one of the honors of Islam to express these rights by Imam Ali (A.S) in the ruling charter.
