Transaction of Body Organs in Iranian Law With Special Approach to Imam Khomeiniʹs Jurisprudential Viewpoints

The knowledge 01 organ transplantation has led to a numher of legal and ethical issues. One or these issues is the financial relationship between the donor and the receiver. The issue of transaction of body organs has received different reactions of the religious scholars. Given the lack of explicit legal text on the issue, it is necessary to pay attention to the jurisprudential and legal foundations of this transaction. In the light of the jurisprudential viewpoints of Imam Khomeini, the present article in the first place discusses the issue that organs of the body are oneʹs property. Then the mode of manʹs relations with his organs arc discussed and finally in the light of the correctness of transactions, the transaction of body organs is legal in special cases.
