Exclusionary Rule In Afghan Criminal Law

"Exclusionary Rule" is a basic principle of Criminal Law. This Principle has been recognized in Afghan Criminal Codes. Article 7 of Afghan interim Criminal Procedure Code (2003) Provides that: 1- The evidence which has been collected without respect of the legal requirements indicated in law is considered invalid and the Court can not base its judgment on it. in this article, the concept and the necessity of exclusionary Rule in Criminal process have been explained and the situations which this principle would be violated have been considered. And finally it has been mentioned as in conclusion, that the recognition of this article is one of the positive points in new Afghan Criminal Laws.
