Civil and Penal Responsibilities of the Physicians with Reference to Imam Khomeiniʹʹs Views

مبحث مربوط به مسيوليت پزشك از دير باز مطرح بوده و نظريات مختلفي از سوي فقها وحقوق‌دانان در اين خصوص مطرح گرديده است. هدف پژوهش حاضر اين است كه با محور قرار دادن نظريات فقهي امام خميني، نظريات موافق و مخالف را مطرح كرده و با بررسي نظريات فقها و مواد قانوني مربوط به مسيوليت پزشك، بتواند انتخابي منطقي، سازگار با نيازهاي جامعه و پاسدار حقوق و منافع بيماران و پزشكان به‌عمل آورد و معضلات و مشكلات موجود را درخصوص مسيوليت پزشك حل نمايد. بنابراين، ابتدا مفهوم و شرايط تحقق مسيوليت پزشك مطرح گرديده و سپس مسيوليت كيفري و مدني پزشك در قانون مجازات اسلامي و از ديدگاه فقهاي عظام و امام خميني بررسي شده است.

The issue of the responsibilities of the physicians have been the matter of debate since long ago and different views have been offered by the Jurisprudents and lawyers in this regard. The aim of the present article is to deal with opposing views with special reference to Imam Khomeini is views and find out a logical solution to be compatible with the requirements of time and society and protect the rights and interests of the patients and physicians. Therefore, first the concept and conditions of the realization of the responsibilities of a physician was treated then the civil and penal responsibilities of the physicians in Islamic penal code was explored and finally Imam Khomeini and other Jurisprudentʹs views was studied.
