The Position of Theoretical Foundations in the Understanding and Illustration of the Intellectual Property System

مبناي مالكيت فكري، بخشي از مباحث فلسفه مالكيت فكري است كه در آن پاسخ به چرايي مشروعيت مالكيت فكري داده مي‌شود. تحليل مبنا، تنها به يافتن دليل مشروعيت مالكيت فكري منحصر نمي‌گردد، بلكه بر نظام مالكيت فكري، تقسيمهاي آن، حقوق مترتب بر پديده فكري، شرايط حمايت و اموري از اين قبيل تاثيرگذار است. نوشتار حاضر تلاش مي‌كند با مرور بر مهم‌ترين مباني مالكيت فكري، تاثير آن را بر نظام مالكيت فكري بيابد.

The foundation of intellectual property constitutes a part of discussions on the philosophy of intellectual property, providing answers to the question as to the reason why intellectual property is legitimate. Analysis of the foundation does not confine to the discovery of the cause of legitimacy of intellectual property, but is of some effects on such matters as the system of intellectual property, its divisions, rights arising from intellectual phenomenon, conditions of support and so on. Casting a cursory glance at the most important foundations of intellectual property, this article tries to find their effect on the system of intellectual property.
