انعطاف پذيري احكام شريعت اسلامي از ديدگاه قرآن كريم و احاديث نبوي ( مبحث عبادات)

Flexibility of the Islamic Sharia’h Laws from the Viewpoint of the Holy Quran and the Prophetic Hadith (the Realm of Worship Acts)

دين اسلام كامل ترين دين الهي است و داراي برنامه اي جامع براي رساندن بشر به سعادت در دنيا و آخرت است. احكام آن در عين آنكه پر نغز و آكنده از حكمت است، از ويژگي انعطاف پذيري و سادگي برخوردارند و بدان گونه نيستند كه مكلف را در سختي و تنگنايي قرار دهند. خداوند (تعالي) ، هدف از تشريع احكام را آسودگي و راحتي بند گان ذكر نموده، نه مشقت و سختي آنان. نبي اكرم (ص) نيز، از شريعت اسلامي با عنوان « سمحه و سهله» ياد كرده اند. با اين وجود عده اي از دشمنان اسلام، سعي در مخدوش نمودن چهره اين آيين بزرگ الهي داشته و با سخت و خشن جلوه دادن احكام آن، شريعت اسلام را دين دست و پاگيري معرفي كرده اند كه با مقتضيات زمان و دنياي امروزي همخواني نداشته و با حقوق بشر در تضاد است. در اين تحقيق كوشش شده با ذكر مصاديق متعددي از احكام عملي كه بر، انعطاف پذيري و سادگي احكام شريعت اسلامي دلالت دارند، مثل: تيمم به جاي وضو، افطار روزه و شكسته شدن نمازهاي چهار ركعتي در حال سفر، وجود قواعدي چون « لا ضرر» و «لا حرج» ضمن تاكيد بر انعطاف پذيري احكام دين اسلام، به رد و ابطال شبهات مخالفان پرداخته شود.

Islam is the most perfect Devine religion and has a comprehensive plan to lead man to happiness in this world and the Hereafter. Islamic rules are full of wisdom and excellence. At the same time, they are flexible and simple and never cause hardship for those who practice them. God, the Most High, says that the aim of legislating Divine rules is to provide convenience rather than hardship and adversity for man. The holy Prophet (p.b.u.h.) has also referred to the Islamic Sharia’h as ‘samhah (forgiveness) and sahlah (leniency)’. However, some enemies of Islam attempt to impair the image of this Devine religion and calling it a violent religion, they point out that it is a cumbersome faith which is not compatible with the requirements of modern life and is in conflict with human rights. Presenting numerous examples of Islamic practical laws indicating the flexibility and simplicity of the Islamic Sharia’h such as tayammom (dry ablution) instead of ablution, breaking of the Fast, shortening four-rakʹah prayers while traveling, and existence of rules such as ‘la zarar’ and ‘la haraj’, this research work attempts to reject and refute the enemies’ doubts and highlight the flexibility of religious laws in Islam.
