ارزيابي تحليلي لايحه جامع خدمات‌رساني به ايثارگران از منظر كيفري‌ـ جرم‌شناختي

An Analytical Assessment of the “Comprehensive Servicing of the Devotees Draft” From the Penal-Criminological Viewpoint

در قانون برنامه چهارم توسعه، لزوم حمايت جامع از ايثارگران به ويژه به عنوان عاملان نتايج پيروزمندانه هشت سال دفاع مقدس، مطرح شد و بر اين اساس، مجمع ايثارگران مجلس شوراي اسلامي با همكاري برخي نهادهاي اجرايي، با تعقيب مسيله تدوين "لايحه جامع خدمت‌رساني به ايثارگران"، "بخش حقوقي و قضايي لايحه جامع خدمت‌رساني به ايثارگران" را تصويب كرده، در معرض بحث و بررسي نهايي نهادهاي ذي‌ربط در دولت قرار داده‌اند. در اين نوشتار، چارچوب بخش حقوقي و قضايي اين لايحه را با درنظر گرفتن نگرشهاي نوين حقوقي به مسيله جرايم نيروهاي مسلح و روند رسيدگي به جرايم آنها و با تكيه بر ملاحظات موثر بر رزمندگان (به‌ويژه بسيجيان) و ايثارگران ( را با هدف سهيم بودن در ارزيابي اين متن و كمك به بررسي دقيق و تصميم‌گيري كارشناسانه مراجع و مقامات صالح) تجزيه و تحليل خواهيم كرد و در نهايت، ضمن نقد متن مذكور، راهكارهاي مناسب را براي تبيين موضع‌گيري بسيج در اين رابطه ارايه خواهيم نمود.

The Fourth Development Plan Act provided for the necessity of protection to Devotees (isargaran), especially as they are the very means by which victory achieved in the 8 Year Holy War, whereby the Majlis Shoraye Islami Devotees Assembly has, in cooperation with some administrative institutions, approved the legal and judicial section of the Comprehensive Servicing of the Devotees Draft, by Pursuing the formulation of the draft itself, leaving it open to be discussed by the concerned institutions of the government. This article analyzes the framework of the legal and judicial section of the draft, by considering the modern legal approaches to the crime issues in the armed forces and how their crimes are being investigated, focusing on the considerations that will affect the Razmandegan (warfighters especially the Basijis and the Devotees, with the aim of taking a part in evaluating this text and assisting with careful examination and expert decision making on the part of the right authorities. Finally, in addition to criticizing the above mentioned text, appropriate options are provided for explaining Basij’s stance in this regard.
