The Right of Disclosure of Artwork

«حق افشاي اثر» از حقوق معنوي پديدآورنده اثر ادبي و هنري است كه براساس آن، پديدآورنده حق دارد درباره عرضهكردن يا عرضهنكردن اثر خود به عموم تصميمگيري كند. حق يادشده كه براي حمايت از شخصيت پديدآورنده در نظام حقوقي فرانسه بهصراحت پذيرفته شده است، از متون قانوني ايران نيز قابل استنباط است. به منظور گسترش متون حقوقي ايران در زمينه حق افشاي اثر، نوشتار حاضر ضمن تبيين مفهوم و قلمرو حق افشا، چگونگي اجرا و پايانيافتن حق افشا و آثار مترتب بر اعمال حق مزبور در دو نظام حقوقي ايران و فرانسه را بررسي كردهاست. با توجه به يافته تحقيق حاضر، اعمال حق افشا عمل حقوقي يكجانبه، و مستلزم وجود و ابراز اراده و اصولاً نيازمند رضاي شخصي پديدآورنده است. حق افشا كه با نخستين اعمال آن پايان مييابد، زمينهساز پيدايش حقوق مالي پديدآورنده است، در نتيجه، تا قبل از اعمال آن، امكان توقيف اثر ادبي و هنري بهمنظور بهرهبرداري مالي ميسر نيست. حق يادشده بر لزوم اجراي تعهدات قراردادي پديدآورنده تاثيرگذار است. هرچند اين امر مسيوليت پديدآورنده در قبال خسارتهاي طرف قرارداد را از بين نميبرد.

The right of disclosure of artwork is one of the moral rights of authors. According to that right, authors are entitled to decide whether their artwork be published for public or not. This right has expressly been laid down in the French law in order to protect authors’ rights. It can also be deduced from the Iranian law. For the purpose of improving the current Iranian law on the issue, this research has been studying on the ways of execution, termination and influences of the mentioned right in the French law in comparison with the Iranian law while it has explained the definition and dominion of the right of disclosure. We conclude that the right of disclosure is a unilateral legal act and it needs to declare by intention and it also requires personal consent of authors. The right of disclosure which is ended by its first publication will lead to authors’ economic rights. Therefore, it cannot be used for economic exploitation before being published
