مسووليت كشورهاي ناتوان با تاكيد بر استفاده كنش‌گران غيردولتي از سرزمين آنان در حمله به كشور خارجي

Responsibility of Failed States with Emphasis on the Use of Non-state Actors of Their Territory in Attack against Foreign State

پايان جنگ سرد مصادف با ظهور چشمگير كشورهاي ناتوان در حقوق بين الملل بوده است. حضور فعال كنش گران غيردولتي در قرن بيست و يكم به همراه بروز كشورهاي ناتوان كه در وضعيت نابساماني به سر مي برند مشكلات فراواني را براي جامعه بين الملل به دنبال داشته است، حال اگر اين كنش گران در چنين كشورهايي مامن گزينند و اقدام به فعاليت نمايند، تهديدي كه از سوي كشورهاي ناتوان متوجه جامعه بين الملل مي شود چندين برابر خواهد شد و بسيار ضروري است كه اين موضوع در مركز توجه قرار گرفته و راه حلي براي آن انديشيده شود تا صلح و امنيت هرچه بيش‌تر در سطح بين الملل حكم فرما شود. در صورت انتساب فعاليت كنش گران به كشورهاي ميزبان، ترديدي در مسووليت آن ها و حق كشور قرباني به دفاع مشروع نخواهد بود، اما اگر كنش گران غيردولتي با سو استفاده از ناتواني كشورهاي ميزبان از سرزمين آن ها عليه كشورهاي ديگر اقدام به حملات خرابكارانه نمايند، حق كشورهاي قرباني به پاسخ مسلحانه به اقدامات كنش گران باقي خواهد بود هر چند رعايت اصل حاكميت و تماميت سرزميني كشورهاي ناتوان ايجاب مي كند كه پاسخ تنها محدود به پايگاه هاي كنش گران باشد و دامنه آن به ديگر مناطق كشور ميزبان تسري نيابد.

The end of the Cold War coincided with the impressive appearance of failed states in international law. Active presence of non-state actors in the Twenty-first Century with the emergence of failed states that inhabit unorganized condition, have had many problems for the international community. Now if these actors in such states choose a shelter and take action, the threat of failing for the international community will be escalated. Thus it is vital that this issue should be the center of attention and there is a must to find a solution in order to maintain peace and security at the international level. If the act of actors is attributed to the host states, there remains no doubt about the responsibility and the right to self-defense of the victim states; however, if the non-state actors abuse the inability of host states and take subversive attacks from their territory against other states, the right of the victim states to armed response to the actions of actors will remain although observance of the principle of sovereignty and territorial integrity of the failed states requires the response be restricted to only the bases of actors, and its scope does not spread to other areas.
