فلسفه حضانت، تحقق مصالح طفل و دفع هر گونه ضرر و زياني از اوست، بنابراين اگر والدين شايستگي و شرايط لازم را نداشته باشند، حق حضانت از آنها سلب مي‌شود. در ماده 1173 قانون مدني نيز امكان سلب حضانت از دارنده آن پيش‌بيني شده است. از آنجا كه يكي از شروط سرپرست طفل، سلامت جسمي اوست، در اين پژوهش با تحليل آرا فقها به بررسي تاثير بيماري‌ها در سلب حضانت پرداخته مي‌شود. در ادامه مشخص مي‌شود كه اگر با بيماري مسري سرپرست، صحّت جسماني طفل در معرض خطر قرار بگيرد؛ بدين‌نحو كه بيماري به طفل سرايت كرده و موجب اضرار او شود، يا اين كه سرپرست به خاطر بيماري صعب‌العلاج، قادر به نگهداري طفل نباشد، حق حضانت وي ساقط مي‌شود. اما اگر وي ‌بتواند از سرايت بيماري به طفل جلوگيري كرده و يا از طريق مباشر، امور و مصالح مربوط به نگهداري و تربيت طفل را انجام دهد، اصل، بقاي حضانت اوست.

Also in the article 1173 of the Civil Code, child custody deprivation from its holder is considered. Since one of the qualifications of childʹs supervisor is his (her) physical health, this paper, by analysis of juristsʹ opinions, is going to examine the impact of illnesses on child custody. It further surveys that if the guardian has an infectious illness, endangering childʹs physical health, or he (she) is not able to keep the child due to an incurable disease, his (her) custody will be void. But if the guardian be able to prevent the spread of illness to the child or does the affairs resulting the maintenance and upbringing of the child through an agent for example, child custody will be constant according to the legal rule.
