اصول تدوين قوانين و مقررات براي اينترنت با تاكيد بر مصوبات يونسكو و شوراي اروپا

Principles of Codification for the Laws and Regulations of the Internet with the Emphasis on UNESCO and European Council Documents

امروزه اينترنت نقش مهمي در تامين حق آزادي بيان داشته و با رفع محدوديتهاي انتشار، جستجو و دريافت اطلاعات، زمينه استفاده از اين حق بنيادين را فراهم نموده است. اين ابزار نوين ارتباطي، مانند هر امر اجتماعي ديگر، نيازمند نظامدهي از طريق وضع قوانين و مقررات لازم الاجرا است. بدون ترديد، اين فرآيند براي اينترنت، زماني ميتواند مفيد و موثر باشد كه با درك صحيح از ويژگيهاي اين رسانه و ابزار ارتباطي نوين و شرايط جامعه، وضع شده و اجرا شود. در اين نوشتار تلاش شده تا با توجه به وضعيت فعلي و تحولات اينترنت در آينده نزديك و تجربيات بينالمللي و منطقهاي(يونسكو و شوراي اروپا) اصولي براي تدوين قوانين و مقررات حقوقي اينترنت، شناسايي و معرفي شود. به نظر ميرسد اين اصول بايد در سياستگذاريها و مقررات گذاريها همواره مورد توجه باشد.

Nowadays, internet has a pivotal role in supporting the right for freedom of expression; by removing the restrictions of publication, search, and access to information, it has prepared the ground for the application of this fundamental right. This new communication tool, like all other social topics, require organization through development of enforceable rules and regulations. Undoubtedly, to become effective process, it requires a true knowledge of the specific characteristics of this media and new communication tools within the context of the society. In this essay– considering the current state of the internet and the possible changes that may occur in the short-term and regional and international experiences (UNESCO and European Council) – we attempted to identify and introduce some principles for the codification of internet laws and regulations. It seems that these principles must be regarded in policy making.
