بررسي تطبيقي خدمات‌رساني به بزه‌ديدگان تروريسم و جنگ

A Comparative Study of Helping the Victims of Terrorism:

زمينه و هدف: خدمات‌رساني به بزه‌ديدگان بين‌المللي با توجه به جنبه بين‌المللي موضوع، نيازمند مشاركت كشورها است. «اعلاميه اصول اساسي عدالت براي بزه‌ديدگان و قربانيان سو استفاده از قدرت» را مي‌توان نقطه اوج تلاش‎هاي جامعه بين‌الملل و در راس آن سازمان ملل متحد براي حمايت از بزه‌ديدگان به‌شمار آورد كه به رويكرد بين‌المللي به بزه‌ديده جنبه جهاني بخشيد. در اين ميان، بزه‌ديدگان تروريسم و جنگ با توجه به ابعاد صدمات و خسارت‌هاي مادي و معنوي نيازمند حمايت و توجه ويژه از جانب دولت‌ها و جامعه بين‌الملل هستند. هدف اصلي مقاله حاضر مطالعه نظام حقوقي كشورهاي مختلف- به‌خصوص ايران- و اسناد بين‌المللي، نحوه حمايت از بزه‌ديدگان تروريسم و بزه‌ديدگان جنگ و خدمات‌رساني به آنان مي‌باشد. روش: روش تحقيق در اين مقاله از نوع توصيفي بوده و اطلاعات نيز بصورت كتابخانه اي جمع آوري شده است. يافته‎ها: اين تحقيق نشان مي‌دهد كه بزه‎ديدگان بين‌المللي حوادث تروريستي و جنگ از اهميت ويژه اي برخوردار هستند. توجه به نيازهاي مادي و معنوي شخص بزه‌ديده و خانواده وي از عمده مسايل مهم در اين زمينه است. نتيجه‎گيري: در نظام حقوقي ايران، برخلاف ساير بزه‌ديدگان (از قبيل سالمند، جرايم جنسي و ...)، توجه ويژه‌اي به بزه‌ديدگان جنگ- شهدا، جانبازان و خانواده‌هاي آنان- شده و طيف وسيعي از خدمات و حمايت‌ها نسبت به آنان پيش‌بيني شده است. اميد است با تصويب قوانين و آيين‌نامه‌هاي مربوطه، ساير بزه‌ديدگان نيز مشمول چنين خدماتي از جانب قانون‌گذاران و سياستگذاران قرار گيرند. واژگان كليدي: خدمات‌رساني، بزه‌ديدگان تروريسم، بزه‌ديدگان جنگ، اسناد بين‌المللي

A Comparative Study of Helping the Victims of Terrorism: From the Perspective of Iranian Law and International Documents Mehdi Yousefi Maraghe Abstract Context and objective: Helping the international victims is an international problem entailing the involvement of different countries. “The Manifest of the Basic Principles of Justice for the Victims of Power Abusing” can be considered the pinnacle of the attempts of international society, especially the UN to support the victims. This Manifest made the concern worldwide. The victims of war and terrorism, among all the others, need a special national and international attention. This research is to study the legal system of different countries –especially Iran –and international documents, the ways of helping terrorism and war victims. Methodology: The method is descriptive and the data are accumulated in a library way. Findings: This research shows that the international victims of terrorism and war are really important. What is worth considering is to pay attention to the mental and materials needed for these victims and their families. Results: It is shown that in Iranian law system, unlike other victims (such as the old, sexual crimes, child abuse, etc) a kind of good support is directed toward the victims of war.
