بررسي راهكارهاي توانمندسازي ضابطين در رعايت حقوق متهمين با رويكرد جرم‌شناختي

Investigating the Ways of Bailiffs' Empowerment in Observing the Rights of Accused Persons with a Criminological Approach

زمينه و هدف: امروزه رعايت حقوق متهمين يكي از مباحث بسيار مهم حقوق شهروندي است. حفظ حقوق متهمين ارتباط تنگاتنگي با اقدامات و تصميمات ضابطين دارد. در اين راستا ضابطين نيز بايد نسبت به مسائل قانوني و رعايت حقوق متهمين و مجازات نقض آنها آگاهي كافي داشته و در اجراي آن دقت لازم را نمايند. هدف اين پژوهش بررسي و ارائه راهكارهاي لازم جهت توانمندسازي ضابطين بالاخص ضابطين عام دادگستري (ناجا) به منظور رعايت حقوق متهمين مي‌باشد. روش‌شناسي: اين پژوهش از نوع كاربردي و با استفاده از روش توصيفي- تحليلي با ابزار كتابخانه‌اي- اسنادي و ميداني اطلاعات لازم را گردآوري نموده است. يافته‌ها: در حال حاضر با توجه به پيچيدگي، تنوع و افزايش جرائم، حقوق شهروندي متهمان به نحو مطلوب و قانونمند رعايت نمي‌گردد. با توجه به اين‌كه برابر قانون حجم كثير مأموريت‌هاي ضابطين به رده‌هاي اجرايي ناجا منجمله كلانتري‌ها و پاسگاه‌ها واگذار گرديده است مشكلات مأموريتي در حوزه ضابطين عام، راهكارهاي مناسب در جهت توانمندسازي آنها را برابر چهارچوب قانون ارائه نمايد. و نتايج اين پژوهش مهم وقتي تحقق مي‌يابد كه اولاً قانون در مورد آنها شفافيت لازم را داشته باشد ثانياً نسبت به اجراي آن برنامه‌ريزي و نظارت لازم صورت گيرد و نهايتاً اين‌كه آموزش‌ها و نظارت‌ها حتماً بايد هدفمند و در راستاي توانمندسازي ضابطين صورت پذيرد.

Background and objectives: Today, observing the rights of accused persons is one of the most important issues of citizenship rights. The maintaining the rights of the accused person is closely related to the actions and decisions of the bailiffs. In this regard, the bailiffs should be aware of the legal issues and observing the rights of the accused persons, and the punishment for violating them, and make sure that they are implemented accurately. The purpose of this research is to investigate and provide necessary strategies for empowerment of the bailiffs, in particular, the general bailiffs of justice (I. R. I. Police) in order to observe the rights of accused persons. Methodology: The present study is of an applied research type. The required data were gathered using a descriptive-analytic method and library and documentary and field studies. Findings and Results: Currently, due to the complexity, diversity and growing the number of crimes, the citizenship rights of the accused persons are not desirably and legally observed. Due to the fact that, in line with the law, the large volume of missions of bailiffs has been assigned to I.R.I. Police executive headquarters, including police stations and checkpoints, considering the mission problems in the field of general bailiffs, appropriate solutions to empowerment of the bailiffs should be provided in line with the law framework. an‎d the results of this important research are realized when the law is firstly clear for them, secondly, the necessary planning and monitoring is required for its implementation, and finally, the trainings and supervisions must be conducted in line with the bailiffs' empowerment.
